2. Data, purposes and legal bases

We process contact, customer-account, order, billing, payment-status, delivery and communication data. When you visit the shop, technical data such as your IP address, device, browser, access time and pages viewed, as well as cookie and consent settings, are also generated. Usage and advertising events are processed after you give consent.

Order, payment and delivery data marked as mandatory are required to conclude and perform the contract. Without this data, we cannot process the order. Optional information and consent to newsletters or non-essential technologies are not required to make a purchase.

We use this data to provide the shop and customer accounts, fulfil orders, process payments and deliveries, respond to enquiries, prevent misuse and fraud, comply with legal obligations and – after consent – provide newsletters, audience measurement, personalised advertising and reminders.

Our processing is subject to the Swiss Federal Act on Data Protection (FADP). Where the GDPR or UK data protection law also applies, processing is based on performance of a contract and pre-contractual steps, compliance with legal obligations, legitimate interests in operating a secure and functional shop, and your consent for newsletters and non-essential analytics and marketing technologies.

3. Shopify, Shopify Payments and Shopify Network Intelligence

Our shop, checkout and customer accounts run on Shopify. Shopify International Limited, Ireland, and companies engaged by Shopify process the data required for these services. When Shopify Payments is used, Shopify and its payment providers process payment, transaction and fraud-prevention data. Complete card or bank-account details are entered directly with the payment service and are not displayed to us in full.

Shopify Network Intelligence is enabled. Shopify processes information about your interactions with our shop together with interactions with other Shopify merchants and Shopify to provide enhanced services such as security, fraud prevention, search, analytics, personalisation and advertising. Processing for personalised advertising and other non-essential purposes takes place after you give consent. Shopify acts as an independent controller for certain enhanced services.

4. PayPal and delivery

If you pay with PayPal, PayPal receives the data required for payment processing, fraud prevention and statutory checks and processes it under its own responsibility. The PayPal Privacy Statement applies.

For delivery, we send your name, delivery address, contact details and shipment information to the parcel service selected by us. The parcel service used is identified no later than in the shipping confirmation.

5. TikTok

After you give consent for marketing and analytics, we use the TikTok Pixel and TikTok Events API. Technical identifiers, page and product views, cart, checkout and purchase events, and hashed contact data used for matching, such as your email address and, where provided, telephone number, are transmitted to TikTok. This is used to measure and optimise our advertising and to create audiences.

Atsumeru is responsible for collecting and transmitting data through our website. Depending on the advertising feature used, TikTok processes data as a processor, independent controller or joint controller with us; the allocation of roles is governed by the TikTok Business Products (Data) Terms and the applicable jurisdiction-specific terms. 6. Newsletter and Shop reminders

After you subscribe, we use your email address and subscription and consent records for the Atsumeru newsletter. You may withdraw consent at any time using the unsubscribe link in every message or by emailing info@atsumeru.ch.

Shop reminders by Shopify are enabled. Shopify recognises eligible Shop users when they visit our shop and, in accordance with their Shop settings and any required consent, sends email or push reminders about viewed products, abandoned carts, back-in-stock items and price changes. The Shopify privacy policy and the settings of the relevant Shop account apply.

7. Cookies, local storage and consent

Essential cookies and comparable storage technologies enable the shop, cart, checkout, customer account, language selection and privacy settings to function. For the welcome-discount pop-up, information is stored locally on your device showing whether the pop-up was closed or the newsletter subscription was completed.

Analytics, personalisation and marketing technologies are activated only after you give consent. You can change your selection at any time via the cookie settings on the website. Withdrawal applies for the future.

8. Recipients and international processing

Recipients are Shopify and its subprocessors, Shopify Payments, PayPal, TikTok and the selected parcel service. We disclose data to public authorities where we are legally required to do so.

The Shopify data region selected for the shop is the EU. Shopify, PayPal, TikTok and their subprocessors also process data outside Switzerland and the EEA. Their current provider lists name, among other locations, Canada, the United States, the United Kingdom, Australia, Brazil, China, India, Israel, Japan, Malaysia, New Zealand, the Philippines, Singapore and South Korea. For countries without a recognised adequate level of data protection, the providers rely on recognised standard contractual clauses and other safeguards provided by law. Current recipients and locations are listed in the linked privacy policies and the Shopify subprocessor list. Information about the transfer mechanisms used and available copies of the safeguards can be obtained from the providers or from us on request.

9. Retention

We generally retain order, invoice and accounting records for ten years. Customer account data is retained while the account is active and afterwards only for as long as necessary to comply with legal obligations, establish, exercise or defend legal claims, maintain security, prevent fraud or retain technically necessary backups. We process newsletter data until you unsubscribe; necessary evidence and suppression records are retained afterwards. Other data is deleted or anonymised when it is no longer required for its purpose, legal obligations or the establishment, exercise or defence of claims.

10. Your rights

Subject to applicable law, you may request access, correction, deletion, restriction, disclosure or transfer of your data, object to processing and withdraw consent. Please send requests to info@atsumeru.ch. To prevent misuse, we may request proof of identity.

You may lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) or, where applicable, the competent foreign data protection authority. Rights against Shopify can also be exercised through the Shopify Privacy Portal.

11. Security and changes

We implement appropriate technical and organisational measures. Completely risk-free transmission of data is nevertheless not possible. We update this Policy if our processing or the law changes materially. The version published on the website applies.
