1. Scope and seller
These Terms and Conditions apply to orders placed through atsumeru.ch. Your contracting party is:

Mandatory consumer rights take precedence over these Terms and Conditions.
2. Orders and conclusion of contract
The products displayed in the shop are an invitation to place an order. By submitting an order, you make a binding offer. The automatic email initially confirms receipt only. The contract is concluded when we expressly accept the order, confirm dispatch or send the goods. If we cannot accept an order, we will inform you and refund any payment already received.
Product images may differ slightly because of screen display or changes made by the manufacturer. The product description and the stated language and edition are decisive.
3. Prices and payment
The total price shown at checkout when the order is completed is decisive. Shipping charges and other costs that can be calculated in advance are shown before purchase. Payment is made using a method offered at checkout.
For international deliveries, import taxes, customs duties and clearance fees are not collected by Atsumeru unless they are expressly shown as included at checkout. Such amounts are charged by the authorities or carrier and are payable by the recipient.
4. Availability and pre-orders
Release and delivery dates for pre-orders are estimates based on information from manufacturers or suppliers. We will inform affected customers of a significant delay.
When in-stock and pre-order items are ordered together, we generally dispatch the order once all items are available. An earlier partial shipment is made only by agreement. We charge additional shipping costs only with prior consent. If we initiate a partial shipment, no additional shipping costs apply.
If an ordered item unexpectedly becomes unavailable, we will inform you and refund the amount paid for that item. Mandatory statutory rights remain unaffected.
5. Delivery
We currently deliver to Switzerland, Australia, Austria, Belgium, Canada, Czechia, Denmark, Finland, Germany, Hong Kong SAR, Ireland, Israel, Japan, Malaysia, the Netherlands, New Zealand, Norway, Poland, Portugal, Singapore, South Korea, Spain, Sweden, the United Arab Emirates, the United Kingdom and the United States. The delivery countries available at checkout when the order is placed are decisive.
Delivery is made to the address provided using a parcel service selected by us. In-stock goods are usually dispatched within 2 working days after payment is received. Any transit times shown are estimates unless expressly stated to be binding. Mandatory rights in the event of delayed delivery remain unaffected.
Free shipping on orders of CHF 180 or more applies exclusively to delivery addresses in Switzerland.
6. Defects and statutory rights
Your statutory rights in relation to faulty or non-conforming goods apply. We provide an additional voluntary guarantee only where one is expressly stated for the product. Please inspect the delivery after receipt. Under Swiss law, apparent defects must be reported without delay and hidden defects without delay after discovery. A late report may affect statutory rights relating to defects. Mandatory consumer rights abroad remain unaffected.
Please send your order number and a description of the defect, together with photographs where possible, to info@atsumeru.ch. For faulty, damaged or incorrectly delivered goods, the remedies provided by law apply.
7. Withdrawal, cancellation and returns
For ordinary online purchases in Switzerland, we do not offer a voluntary right to withdraw, return or exchange goods that are free from defects. Mandatory statutory rights, particularly those of consumers in the EU, EEA and United Kingdom, remain unaffected. Details are provided on the “Withdrawal and returns” page.
8. Liability
We have unlimited liability for loss or damage caused intentionally or through gross negligence, for death, personal injury or damage to health, and wherever liability is mandatory by law. Where an essential contractual obligation is breached through slight negligence, our liability is limited, to the extent permitted by law, to loss or damage that was foreseeable and typical for the contract; liability for other cases of slight negligence is excluded. Liability for auxiliary persons is excluded to the extent permitted by law. Mandatory claims, particularly under product liability and consumer law, remain unaffected.
9. Data protection
Our shop is hosted by Shopify. Shopify processes data when you visit or make purchases, including to provide services based on your interactions with other Shopify merchants and Shopify. Details are set out in our Privacy Policy.
10. Governing law and jurisdiction
Swiss law applies to the extent that mandatory conflict-of-laws rules—particularly those governing consumer contracts—do not require another law to apply or exclude a choice of law. The United Nations Convention on Contracts for the International Sale of Goods is excluded to the extent permitted. Jurisdiction is determined by mandatory statutory provisions.
11. Final provisions
The version published when the order is placed applies. Changes do not apply retrospectively to contracts already concluded. If any provision is invalid, the remaining provisions remain effective.
